ÇEKE İLİŞKİN MENFİ TESPİT DAVASININ YARGILAMASINDA ORTAYA ÇIKAN SORUNLAR ÜZERİNE BİR DEĞERLENDİRME

Abstract
Menfi tespit davası, uygulamada en sık başvurulan dava türlerinden biridir. Özellikle çek gibi kambiyo senetlerine dayalı olarak açılan menfi tespit davalarıyla sıklıkla karşılaşılmaktadır. Menfi tespit davası, davalı tarafça varlığı ileri sürülen bir hukukî ilişkinin aslında var olmadığının tespit edilmesi için açılan davaya denir. Davacı, alacaklının ileri sürdüğü borcun borçlusu olmadığını düşünerek maddi hukuka dayalı nedenlerle bu davayı açabilir. Çeke ilişkin menfi tespit davasına ilişkin yargılama sürerken, bazı sorunlar ortaya çıkabildiği tespit edilmiştir. Bu çalışmada, çeke ilişkin menfi tespit davasının yargılamasında karşılaşılabilecek sorunlar incelenmiş ve değerlendirilmiştir.

Abstract
The negative declaration action is one of the most frequently applied types of lawsuits in practice. In particular, negative declaration actions filed based on bills of exchange such as checks are frequently encountered. A negative declaration lawsuit is a lawsuit filed to determine that a legal relationship claimed to exist by the defendant does not actually exist. The plaintiff may file this lawsuit for reasons based on substantive law, considering that the creditor is not the debtor of the debt claimed by the creditor. It has been determined that some problems may arise during the proceedings regarding the negative declaration lawsuit regarding the check. In this study, the problems that may be encountered during the trial of the negative declaration lawsuit regarding the check are examined and evaluated.
